Since 1984, this Practice has specialised in contractual advice and protection for  Electrical, Mechanical  and other Specialist Subcontractors.  The services offered include:

 

 

“VETTING OF ENQUIRY/TENDER/ORDER – RISK IDENTIFICATION"

Identifying onerous risks, “suicide clauses”.

Detailed examination of documents and contract conditions, with written report on onerous clauses, damages, key risks, disadvantageous amendments to standard forms, recommended negotiations for improvement etc.

 

TROUBLED CONTRACTS  - “TROUBLE SHOOTING”

Contractual advice at all stages, reports and recommendations.

Visits to site and/or office, discussions with key personnel, assessment of situation, recommended strategies  for identifying, managing and rectifying problems.

 

CLAIMS FOR LOSS AND EXPENSE, EXTENSION OF TIME               

Preparation, Submission and negotiation.  Protection of entitlements.

Visits to site and/or office, discussions with key personnel, assessment of situation and possible routes for recovery of entitlements. Advise on contractual position.

Guidance as to essential records.

Analysis and assembly of available evidence, creation of data base, preparation of “cause and effect” schedules, impact analysis charts, histograms etc, writing of narrative.

Printing of completed claim document.

Assistance with strategy and negotiations for settlement.

 

SITE RECORDS AND NOTICE SYSTEMS

Visit site and/or office, discussions with key personnel. Examination of existing procedures and paperwork, prepare and submit proposals for site record and notification systems geared to strengthening protection and preserving entitlements, including financial recoveries.

 

SET-OFF, CONTRA CHARGES

Defence against claims from other parties.

All necessary visits and discussions and analysis of contract files, including assessment and critique of claims, set offs and contras received from other parties. Advise and assist with defence, including guidance on contractual position and negotiations, strategies etc.

 

ADJUDICATION – PURSUING PAYMENT ETC

Preparation of case,  Guidance on procedures, Submission to Adjudication.

All necessary visits and discussions, examine contract conditions and advise, analyse current position, recommend strategy for recovery, prepare case for Adjudication.

 

TRAINING SEMINARS

Practical advice for Managers,  Engineers and Supervisors.  Time and place to suit Client.

Specialist in provision of In-Company Seminars, geared to Client’s needs. Half day seminars a speciality.

The range of contracts includes: Hospitals; Schools; Prisons; Airport Extensions; Refurbished Hotels; Banks and Offices; Petro-Chemical Works; Nuclear Facilities; Commercial and Industrial Developments, Theatre and Leisure Complexes, Minor Works etc.
